Formalytics Terms of Service

1. Eligibility

Formalytics is not intended for children under 13. You must be at least 13 years old to use Formalytics. If you are under the age of majority where you live, you may use Formalytics only with permission from a parent or legal guardian.

If you use Formalytics on behalf of a team, club, school, business, or other organization, you represent that you have authority to accept these Terms on behalf of that organization.

2. Accounts

You are responsible for the activity on your account and for keeping your sign-in method secure. You must provide accurate information and keep it current. Do not share your account or use another person's account without permission.

You can delete your account in the app. Account deletion may remove your account, profile, user-owned projects, videos, published clips, workout data, and leaderboard submissions from active systems, subject to safety, backup, legal, and retention limits described in the Privacy Policy.

3. Your content

"Your Content" means content you record, import, upload, publish, submit, save, or otherwise provide through Formalytics, including videos, audio, photos, thumbnails, captions, comments, profile information, workout logs, leaderboard entries, annotations, drawings, notes, measurements, feedback, reports, and related data.

You keep ownership of Your Content. These Terms do not transfer ownership of Your Content to Formalytics.

You are responsible for Your Content. You represent that you have all rights, permissions, releases, consents, and authority needed to upload, publish, submit, and license Your Content, including permission from any identifiable people shown or heard in a video. For minors, this includes permission from a parent or legal guardian where required.

4. License you grant to Formalytics

You grant Formalytics a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, copy, reproduce, process, transcode, analyze, modify, adapt, create derivative data from, display, perform, publish, distribute, transmit, and otherwise use Your Content and related data for the purposes described in these Terms and the Privacy Policy.

This license lets Formalytics:

• operate, maintain, secure, and provide the app and backend services;
• save, sync, render, export, publish, moderate, and delete content;
• show public content, profiles, clips, captions, comments, leaderboards, and rankings to other users;
• create thumbnails, previews, overlays, measurements, keypoints, derived movement data, and analysis outputs;
• detect abuse, fraud, security issues, copyright issues, false submissions, and Terms violations;
• improve, develop, test, train, validate, and evaluate Formalytics products, services, AI systems, and machine-learning models.

This license continues for as long as needed to provide Formalytics and to preserve content that remains published because you have not deleted it, copies other users saved where the app allows saving or resharing, safety records, de-identified or aggregate data, backups, legal records, and model-training outputs that no longer identify you. If you delete content or your account, we will remove Your Content from active systems where reasonably possible, subject to the Privacy Policy and applicable law.

5. AI and machine-learning model training

Formalytics may use Your Content, usage data, feedback, reports, and derived data to develop, train, test, validate, evaluate, improve, and operate AI and machine-learning models and features. This includes models and systems for video analysis, pose estimation, ball tracking, movement analysis, training recommendations, coaching cues, quality control, fraud detection, safety, moderation, and product analytics.

The license in these Terms includes using videos, audio, images, annotations, keypoints, metrics, workout data, profile context, feedback, interaction events, and derived data for those AI and machine-learning purposes.

Formalytics may use contractors, service providers, cloud processors, and affiliates to help with these purposes. We do not give third-party model providers the right to use Your Content to train their own independent models unless we disclose that practice or obtain permission where required.

You can contact us at lovo@lovison.id.au about deletion, access, or future AI-training use of private content where required by law or where we offer an opt-out.

6. Social and public features

Formalytics may include profiles, public feeds, leaderboards, published clips, captions, comments, likes, follows, shares, saves, reports, blocks, and other social features. Content you publish or submit to public features may be visible to other users and may be copied or reshared by others.

Do not publish content unless you are comfortable with it being public and you have the right to share it. Do not publish private, confidential, sensitive, harmful, exploitative, or unlawful content.

7. Content and conduct rules

You must not upload, publish, submit, or promote content or behavior that:

• is unlawful, threatening, abusive, harassing, hateful, defamatory, invasive of privacy, or deceptive;
• sexualizes, exploits, endangers, bullies, or targets minors;
• contains nudity, sexual content, graphic violence, self-harm instructions, or dangerous conduct not appropriate for a sports analysis app;
• infringes copyright, trademark, privacy, publicity, or other rights;
• includes another person's personal information without permission;
• misrepresents sports performance, leaderboard scores, identity, age, school, team, or eligibility;
• contains malware, spam, scams, automated scraping, credential attacks, or attempts to disrupt the service;
• violates any law, these Terms, community rules, or App Store requirements.

8. Moderation, reports, blocks, and takedowns

We may review, remove, restrict, label, demote, hide, preserve, or refuse to publish content or accounts that we believe violate these Terms, create legal risk, create safety risk, or harm the service.

You can report abuse, objectionable content, copyright concerns, privacy concerns, impersonation, or safety issues by emailing lovo@lovison.id.au. Include the account name, clip, leaderboard entry, URL or screenshot if available, and a short explanation.

If in-app reporting or blocking tools are available, you may also use those tools. We may suspend repeat infringers, block abusive users, remove content, preserve evidence, or notify law enforcement, safety bodies, regulators, or rights holders where appropriate.

9. Sports, fitness, and health notice

Formalytics provides sports analysis and training tools. It is not medical advice, clinical advice, injury diagnosis, treatment, or a substitute for a qualified coach, doctor, physiotherapist, athletic trainer, or other professional. Use judgment, train safely, and stop if you feel pain, dizziness, or unsafe conditions.

10. Privacy

The Privacy Policy explains how Formalytics collects, uses, shares, retains, and deletes information, including content, analytics, diagnostics, and AI-training data.

11. Suspension and termination

We may suspend, restrict, or terminate access to Formalytics if we believe you violated these Terms, created risk for users or the service, infringed rights, submitted false leaderboard data, abused social features, or used the service unlawfully.

You may stop using Formalytics at any time and may delete your account in the app.

12. Disclaimers and limits

Formalytics is provided on an "as is" and "as available" basis. We do not guarantee that measurements, AI outputs, tracking outputs, recommendations, rankings, exports, uploads, or social features will be accurate, uninterrupted, secure, or error-free.

To the maximum extent permitted by law, Formalytics is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of data, profits, goodwill, opportunity, athletic performance, eligibility, reputation, or training outcomes.

Nothing in these Terms excludes rights or remedies that cannot be excluded under applicable law.

13. Australian Consumer Law and governing law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or any other law that cannot lawfully be excluded. To the extent our liability for breach of a consumer guarantee can lawfully be limited, our liability is limited, at our option, to resupplying the relevant service or paying the cost of having it supplied again.

These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts operating there and of the Commonwealth of Australia. This clause does not deprive you of any mandatory protection of the law of the place where you live.

14. Changes to these Terms

We may update these Terms as Formalytics changes. If a change is material, we will take reasonable steps to notify users through the app, the website, or another appropriate channel. Continued use of Formalytics after the effective date of updated Terms means you accept the updated Terms.
